Terms and Conditions

General Provisions

The Epic Mountain Rewards program (the “Program”) is offered by The Vail Corporation ("Vail Resorts") at its sole discretion. By purchasing a qualifying, eligible EPIC pass (“Pass”) and participating in the Program, you (the “Member”) agree to be bound by these Terms and Conditions (the “Terms”) available at https://www.epicpass.com/benefits/EMR-terms-and-conditions.aspx (the "Website”), and Vail Resorts privacy policy available at https://www.snow.com/footer/privacy.aspx. A Member’s continued access and/or use of the Program constitutes agreement to be bound by and comply with these Terms. If you do not agree to be bound by these Terms, you may not participate in the Program.  Employees of Vail Resorts are not eligible for participation in the Program.

If any provision of these Terms is deemed to be unlawful, void, or for any reason unenforceable, such provision will be deemed severed and will not affect the validity and enforceability of the remaining provisions.  The Program is void where prohibited or restricted by law.  The Program does not establish an agency, partnership or joint venture relationship between Vail Resorts and Member.

Vail Resorts reserves the right to terminate or modify the Program and/or these Terms or any element thereof in whole or in part at its sole discretion, at any time, with or without personal notice to Members by posting revised Terms (if applicable) to the Website which will supersede the prior Terms, and continued participation in the Program is deemed Members’ consent to be bound to the revised Terms.  Such changes may affect any aspect of the Program including but not limited to the participating locations, discount categories, Program availability, discount availability or levels, Benefits, or any other elements of the Program.  The Program is personal to Members and does not create a property right.  Members may not share, assign, transfer or otherwise allow any non-Members to utilize the Program. Unauthorized participation and/or use of the Program or a Benefit is prohibited.

Vail Resorts reserves the right to terminate any Member’s participation in the Program in its sole discretion in the event the Member is suspected of being or is found to be ineligible, using artifice, cheating or participating in a fraudulent manner, fails to comply with any of the Terms, or violates local, state or federal law.  Further, if any information provided by a Member is, or if we have reasonable grounds to suspect that any information provided, is false, inaccurate, outdated, intentionally incomplete, or violates these Terms, or any applicable law, then we may suspend or terminate your participation in the Program. 

These Terms are governed by the laws of the State of Colorado regardless of conflict of laws. The parties agree that any disputes between them shall be addressed in accordance with the process stated herein-below and heard only in the state or federal courts in the State of Colorado, and the parties hereby consent to exclusive venue and jurisdiction in those courts.

Vail Resorts shall not be liable to Members or any other person or entity for failure to execute the Program or any element thereof, or supply a Benefit or any part thereof, by reason of any act of God, any action(s), regulation(s) order(s) or request(s) by any governmental or quasi-governmental entity (whether or not they prove to be invalid), any equipment, technical, system or other failure, terrorist act, cyber-attack, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, closures, cancellations or delays, epidemic or pandemic, (or any consequences resulting therefrom) or any similar or dissimilar event beyond its reasonable control.

BY PARTICIPATING IN THE PROGRAM, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW YOU AGREE THAT NEITHER VAIL RESORTS, ITS AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS (COLLECTIVELY, “THE VAIL RESORTS PARTIES”) SHALL HAVE ANY RESPONSIBILITY OR LIABILITY FOR ANY THREATENED OR ACTUAL CLAIM, ACTION, LIABILITY, LOSS, INJURY, DAMAGE, DELAY, ACCIDENT, COST OR EXPENSE (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES AND COSTS OF SUIT), NOR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR DAMAGES (INCLUDING, WITHOUT LIMITATION, FOR LOSS OF OR DAMAGE TO REVENUE, PROFITS, SAVINGS, GOODWILL OR DATA) (COLLECTIVELY, "LOSSES AND DAMAGES"), DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATED TO THE PROGRAM, PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROGRAM OR ANY PART THEREOF, OR INABILITY TO RECEIVE ANY BENEFIT UNDER THE PROGRAM.  THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR ANY OTHER BASIS.  THE VAIL RESORTS PARTIES’ MAXIMUM COMBINED AGGREGATE LIABILITY HEREUNDER FOR ANY CAUSE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH ANY OF THE MATTERS DESCRIBED ABOVE EXCEED SHALL NOT EXCEED TWENTY-FIVE UNITED STATES DOLLARS (U.S. $25.00).  IF ANY OF THE FOREGOING LIMITATIONS OF LIABILITY IS FOUND TO BE VOID, INVALID, OR UNENFORCEABLE FOR ANY REASON BY A COURT OR AUTHORITY OF COMPETENT JURISDICTION, THEN SUCH LIMITATIONS OF LIABILITY SHALL BE CHANGED AND INTERPRETED BY SUCH COURT OR AUTHORITY SO AS BEST TO ACCOMPLISH THE INTENT AND THE OBJECTIVES OF THE ORIGINAL PROVISIONS TO THE FULLEST EXTENT ALLOWED BY LAW AND THE REMAINING LIMITATIONS OF LIABILITY SHALL REMAIN IN FULL FORCE AND EFFECT.  The foregoing limitations of liability will apply to the fullest extent permitted by applicable law even if any of the foregoing events or circumstances were foreseeable and even if the Vail Resorts Parties were advised of or should have known of the possibility of such losses or damages.

In the event Member claims a dispute with Vail Resorts in relation to the Program or under these Terms, and the dispute is not resolved by negotiation, Member agrees to submit the dispute to mediation. Member further agrees that their participation in mediation is a condition precedent to pursuing any other available remedy in relation to the dispute. Member may give written notice to Vail Resorts of their desire to commence mediation, and a mediation session must take place within thirty (30) days after the date that such notice is given. Member and Vail Resorts must jointly appoint a mutually acceptable mediator. In the event Member and Vail Resorts are unable to agree upon the appointment of a mediator within seven (7) days after Member has given notice of their desire to mediate the dispute, Member may apply to J.A.M.S., 410 17th Street Suite 1600 Denver, CO 80202 Phone: 303-534-1254, or such other organization or person agreed to by Vail Resorts in writing, for appointment of a mediator. Member agrees to share equally the costs of the mediation, which costs will not include costs incurred by either side for representation by counsel at the mediation or for related expenses specifically incurred by Member.

Program Benefits and Redemption

General: During the stated applicable Winter and/or Summer North America Season, certain discounts will be offered at locations owned and operated by Vail Resorts towards participating products and services (subject to their availability) as stated herein, only to current Members of the Program (Program “Benefits”) when using an eligible, participating EPIC Pass (“Pass”). The Program, Program Benefits and all elements thereof are subject to being eliminated, expanded, and/or modified in our discretion. Only bookings, reservations and/or purchases (“purchase(s)”) made directly through Vail Resorts in person, through Vail Resorts call center at 970.754.0059 (“Call Center”), at Epicpass.com (“Website”), or through Vail Resorts direct partner portal (“Partner Portal”) will be eligible for these Program Benefits. Purchases through any wholesaler, other website and/or excluded or unauthorized third parties are ineligible for Program Benefits.

Only eligible Members who are Pass holders will receive Program Benefits. By way of example, a Member may book a ski rental at a 20% discount for all the eligible Pass holders/Members in his/her family/group, but such discount cannot be given or applied to non-Pass holders in the same booking. 

Summer Benefits under the Program are only available to Pass holders from the immediately preceding North America Winter season. Vail Resorts reserves the absolute right to validate a Pass and to, among other things, require Members to present their Pass in person or in any other manner acceptable to Vail Resorts at any time. Pass information and eligibility for any Program Benefit is not final until Pass has been validated as required by Vail Resorts. When purchasing over the telephone or online, Members may be required to provide valid Pass information and/or access their account information. Members MUST present a valid Pass in person as required, including without limitation at time of check-in for lodging, and at time of purchase for food and rentals. If for any reason a valid Pass is not presented as required, the purchase will not qualify for a Program Benefit and Member will be required to pay full price. 

Benefits are subject to their specific offer terms and conditions incorporated herein and available at the Epic Mountain Rewards website.(which are subject to change); limitations, restrictions and exclusions apply; all Benefits and purchases are subject to availability, are available only while supplies last, blackout days and restrictions apply; exclude taxes and all fees; cannot be applied retroactively on prior purchases, or on purchase of gift cards, alcoholic beverages, and any other excluded items, products or services stated by the offer terms; and cannot be combined with any private club discounts, or any other offer, discount or promotion (unless allowed by the specific offer in Vail Resorts discretion). Members must follow all instructions for redemption of Program Benefits as set forth in these Terms, the specific offer terms, and as provided in the Epic Mountain Rewards Website and Frequently Asked Questions.

Links to information, such as participating Passes, locations and properties are provided for convenience. We attempt to keep information current, but it is subject to change and may vary between the Winter/Summer seasons, participating Resorts, and/or operation.

THE PROGRAM AND ALL ELEMENTS THEREOF ARE PROVIDED TO MEMBERS “AS IS” AND VAIL RESORTS DOES NOT MAKE AND HEREBY EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT.

Discounted lodging price reflects rate per night, excluding taxes, resort fees and any other fees.
